Welcome to AffordIT (“AffordIT”, “we”, “us”, or “our”). These Terms and Conditions govern your use of our website at affordit.co.nz and the professional services we provide, including website design and development, mobile application development, software development, digital marketing, PPC management, and graphic design.
By accessing our website, requesting a quote, or engaging us to deliver any service, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree, please do not use our website or engage our services.
AffordIT is a New Zealand registered company providing affordable IT and digital marketing solutions to businesses across New Zealand. Our principal place of business is in Auckland, New Zealand.
AffordIT provides the following services (collectively, “Services”):
The specific scope, timeline, deliverables, and fees for any engagement will be agreed in writing (email or formal proposal) before work commences.
4.1 All quotes and proposals are valid for 30 days from the date of issue unless otherwise stated.
4.2 A project commences only upon receipt of written acceptance of a proposal and payment of any required deposit.
4.3 The agreed project scope is defined in the proposal or statement of work. Any requests that fall outside the agreed scope may incur additional fees, which will be communicated to you before work proceeds.
4.4 AffordIT reserves the right to decline any project at its discretion.
5.1 Payment terms for each project will be outlined in the proposal. Typical arrangements include a deposit of 50% prior to commencement and the balance upon completion, unless otherwise agreed in writing.
5.2 Ongoing retainer services (e.g., SEO, PPC management) are invoiced monthly in advance.
5.3 Invoices are due within 14 days of the invoice date unless an alternative arrangement has been agreed.
5.4 AffordIT reserves the right to charge interest on overdue amounts at a rate of 2% per month, calculated daily, from the due date until payment is received in full.
5.5 AffordIT may suspend delivery of Services if payment is significantly overdue, without liability to you.
6.1 Client Materials. You warrant that you own or have the right to use all content, images, logos, and other materials you provide to AffordIT. You grant AffordIT a non-exclusive licence to use those materials solely for the purpose of delivering your project.
6.2 Delivered Work. Upon receipt of full and final payment, AffordIT assigns to you all intellectual property rights in the final deliverables created specifically for your project, except as noted in clause 6.3.
6.3 Third-Party & Pre-existing Assets. AffordIT may use third-party software, frameworks, plugins, stock imagery, or fonts in delivering your project. Ownership of such assets remains with their respective owners, and your use of them is subject to the applicable third-party licence terms. AffordIT’s own pre-existing tools, methodologies, code libraries, and know-how remain the sole property of AffordIT.
6.4 Portfolio Rights. Unless you instruct us otherwise in writing, AffordIT reserves the right to display completed work in our portfolio and marketing materials.

Delays caused by late provision of content or approvals may affect project timelines and AffordIT will not be held responsible for such delays.
8.1 The number of revision rounds included in a project will be specified in the proposal.
8.2 Revisions that fall within the agreed scope are included. Revisions that constitute a change to the agreed scope, or that exceed the included revision rounds, will be quoted separately and require written approval before work proceeds.
9.1 AffordIT applies industry best practices to all digital marketing campaigns. However, we do not guarantee specific rankings, traffic volumes, conversion rates, or advertising results, as these are influenced by factors outside our control, including search engine algorithm changes, market conditions, and competitor activity.
9.2 For PPC campaigns, you acknowledge that advertising spend (paid directly to the advertising platform) is separate from AffordIT’s management fee. You are responsible for funding your advertising account.

Each party agrees to keep confidential any non-public information of the other party that is disclosed in connection with a project, and not to disclose such information to any third party without the other party’s prior written consent, except as required by law.
11.1 AffordIT warrants that Services will be performed with reasonable skill and care.
11.2 AffordIT does not warrant that its website or any delivered software will be error-free, uninterrupted, or free from viruses or harmful components.
11.3 To the maximum extent permitted by applicable New Zealand law, AffordIT excludes all implied warranties, representations, and conditions not expressly set out in these Terms.
12.1 AffordIT’s total aggregate liability to you in connection with any project or these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by you to AffordIT for the relevant project in the 12 months preceding the claim.
12.2 AffordIT is not liable for any indirect, special, consequential, or incidental loss or damage, including loss of profit, loss of data, or loss of business opportunity, even if AffordIT has been advised of the possibility of such loss.
12.3 Nothing in these Terms limits AffordIT’s liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under New Zealand law, including under the Consumer Guarantees Act 1993 where applicable.
13.1 Either party may terminate a project agreement by providing 30 days’ written notice to the other party.
13.2 Upon termination, you will pay AffordIT for all work completed and reasonable costs incurred up to the date of termination, and a pro-rated portion of any milestone payment that is substantially complete.
13.3 AffordIT may terminate a project immediately if you breach a material term of these Terms and fail to remedy the breach within 7 days of written notice.
These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
AffordIT reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised “Last updated” date. Continued use of our website or Services after any update constitutes acceptance of the revised Terms.
